What Happens If an Off-Plan Developer Delays or Cancels? Refunds and Rights in Dubai

General information, not legal or financial advice. Rules and fees change, so confirm current terms with the Dubai Land Department (DLD), RERA or a lawyer before you sign. Official sources were checked on 3 November 2026.

Short answer: If an off-plan developer delays, your first rights are in your contract. Official sources do not set a fixed refund or compensation for a simple delay. If a project is cancelled by RERA, the developer must return buyers' payments from the escrow account; other disputes go through DLD conciliation and the courts, and the Special Tribunal handles unfinished or cancelled projects.

What if the developer is late?

  • Read the SPA first: the handover date, any grace period and any compensation for delay are contract terms. We found no official statute that gives a buyer a fixed refund or compensation for a short delay.
  • Ask for evidence: a completion-percentage report and the escrow status of the project: see how to check a developer and project. DLD's FAQ says you may ask a DLD-approved consultant for a letter on the current completion percentage.
  • Conciliation: the implementing bylaw provides for DLD to try to conciliate between developer and buyer.
  • Court termination in listed cases: the bylaw lets a buyer ask the court to terminate if the developer, for example, refuses without valid reason to deliver the final sale agreement, declines to tie payments to RERA-proposed milestones, materially departs from the agreed specification or delivers a unit unfit due to material defects.

DLD's FAQ states that DLD cannot terminate a contract at the investor's request. A buyer who wants out of a project that has not been cancelled should go to the real estate court.

What if the project is cancelled?

RERA can cancel a project on grounds listed in the bylaw, such as not starting without justification, gross negligence or bankruptcy. DLD's FAQ says that after a cancellation decision the developer is asked to return amounts within 60 days, which RERA can extend, and if it does not comply the matter goes to court. Under the escrow law, a registered project's payments sit in an escrow account that the developer's creditors cannot attach, and if a project is not completed the escrow agent consults DLD to complete it or refund depositors. Decree No. 33 of 2020 created a Special Tribunal for unfinished and cancelled real property projects, whose awards are final; check whether your claim falls within it.

What if you miss payments?

The reverse risk is yours. Under Law No. 13 of 2008 as amended by Law No. 19 of 2020, the developer must give notice through DLD and try amicable settlement first. If the project is more than 80% complete it may keep the payments and claim the balance, auction the unit, or terminate and retain up to 40% of the price paid; between 60% and 80% it may terminate and retain up to 40%; below 60% with construction started, up to 25%. Any excess must be refunded within a year of termination or within 60 days of resale. These are summaries: read the law and your contract.

What to do before you buy

  • Check the delay, cancellation and default clauses and the stated handover date.
  • Confirm the project is registered and your payments go to its escrow account: off-plan guide.
  • Keep payment receipts and correspondence, and get a lawyer to review the SPA before a large payment.
  • Model a delay in your numbers: off-plan ROI analysis.

A RERA complaint is not the route for contract or refund disputes: DLD's complaint service excludes financial claims, contract disagreements, cancellations and compensation.

Frequently asked questions

Can I get a refund if my off-plan property is delayed?

Official sources do not set a fixed refund for a simple delay; it depends on your contract. A buyer can ask the court to terminate in listed cases under the implementing bylaw, and payments are returned if RERA cancels the project.

What happens if an off-plan project is cancelled in Dubai?

RERA can cancel a project on listed grounds, after which the developer is asked to return buyers' payments within 60 days (extendable). If it does not comply, the matter goes to court.

Where do I complain about an off-plan developer?

Disputes about refunds, contract terms and cancellations go to the courts (or the Special Tribunal for unfinished and cancelled projects). RERA's complaint service excludes financial claims and contract disagreements.

Can the developer cancel my contract if I miss a payment?

Under the amended Law No. 13 of 2008 the developer must give notice and try amicable settlement first, and may then terminate and keep part of the payments depending on completion, up to 40%. Read the law and your contract.

Does DLD terminate off-plan contracts?

No. DLD's FAQ says it cannot terminate a contract between developer and investor at the investor's request; it can conciliate, and termination goes to the real estate court.
