Can You Sell Off-Plan Property Before Handover in Dubai? NOC and Resale

General information, not legal or financial advice. Rules and fees change, so confirm current terms with the Dubai Land Department (DLD), RERA or a lawyer before you sign. Official sources were checked on 3 November 2026.

Short answer: Yes, in Dubai you can usually resell an off-plan unit before handover, but the Dubai Land Department (DLD) says you first need a No Objection Certificate (NOC) from the developer. The terms, such as how much you must have paid, the NOC fee and who pays what, are set by the developer and your contract, not by a published DLD or RERA rule.

What does DLD say about reselling off-plan property?

DLD's FAQ says that resale of a unit, or of the deferred sale contract, to a third party before transfer to the land registry is possible after obtaining a No Objection Certificate from the developer. Under Law No. 13 of 2008, units recorded in the Interim Real Property Register may be sold or otherwise disposed of, and a disposition not entered in that register is void. So a resale has to be recorded properly, not agreed privately.

What we could not verify from official sources

  • A minimum percentage you must have paid: we found no DLD or RERA rule. Broker sites quote figures such as 30% to 40%, but these are developer policies, so ask the developer for its current requirement in writing.
  • The NOC fee: no official off-plan resale NOC fee was found. Do not rely on figures quoted in blogs.
  • The exact registration steps for an assignment: DLD's service list shows no dedicated off-plan assignment service, so confirm the procedure with the developer and DLD.
  • Who pays what: the fee resolution splits the 4% registration fee equally unless agreed otherwise, but the resale agreement between seller and buyer sets the practical split.

Is it a good idea to sell before handover?

Selling early can lock in a gain or a loss, and is not guaranteed. Buying costs, any developer NOC or admin charge and agent commission reduce the proceeds, and a sale needs a buyer who accepts the remaining payment plan. See the arithmetic in is off-plan a good investment in Dubai.

If you are buying a resale off-plan unit

  1. Ask for the original SPA, the payment schedule, receipts and the developer's NOC.
  2. Check the project status and escrow details: how to check a developer and project.
  3. Confirm how much has been paid and how much remains, and that both match the developer's records.
  4. Do not pay the seller outside the process the developer and DLD accept. Verify the seller and agent: how to verify agents and listings.
  5. Price it against new launches and ready units: off-plan vs ready.

If a project page says "sold out", as one page in the Danube Properties comparison does, ask the developer whether primary units remain, and treat any resale listing with extra checks.

Frequently asked questions

Can I sell my off-plan property before handover in Dubai?

Usually yes. DLD's FAQ says resale before transfer to the land registry is possible after obtaining a developer NOC, and the sale must be recorded in the Interim Real Property Register.

Do I need a developer NOC to resell off-plan property?

Yes, according to DLD's FAQ. The developer sets its own conditions and fee, so ask in writing.

How much must I pay before I can resell an off-plan unit?

We found no DLD or RERA minimum. Some developers set their own thresholds, so ask the developer for its current requirement in writing.

What does the NOC cost?

No official off-plan resale NOC fee was found on DLD pages. Ask the developer and get it in writing.

Is a private resale agreement valid?

A disposition of an off-plan unit not entered in the Interim Real Property Register is void under Law No. 13 of 2008, so a resale must be recorded properly.
